1. Information We Collect
We collect three types of data:
- Information that you provide to us;
- Information gathered from use of our App and Services;
- Technical data passively collected from our Site and App.
1.1 Information You Provide
When using the Urtopia Site, App and Services, and when you sign up for a Urtopia Account, you may provide us with a combination of Personal Information and Non-Personal Information. Personal Information is information that you provide to us that personally identifies you, such as your name, e-mail address, phone number, password selected to use our Services.
When you register on the mailing list or for our newsletter, your email address will be added to our contact list. We may also collect other information that you directly provide to us, such as when you send us an email, participate in our surveys, provide or request information from customer support, or otherwise submit information to us through our Services. Such information may include Personal Information such as your name, email, telephone number and address. When you request an exchange or refund, we may collect additional information about payment details and reasons for requesting an exchange or refund. All credit card charges and refunds are processed by our third party payors, the Google Play Store and the App Store. Urtopia does not collect or have access to your financial information.
Non-Personal Information cannot reasonably be used to identify you. You may provide this information when you register for a Urtopia account or otherwise complete a transaction using the Urtopia Site.
1.2 Information Gathered from Use
Urtopia only collects information when necessary, with your explicit consent.
Urtopia is proud of its futuristic design and smart functions. Our E-Bike carries a bunch of IOT sensors including fingerprint recognition, torque sensor, gyroscope, mmWave radar and GPS. The data collected can be processed at the local computing unit of the bike to provide basic functions. To use advanced smart features such as cellphone unlock, voice control, remote tracking and riding activity analysis, you need to give Urtopia access to the data. By creating an Account and using the Services, you certify that you provide such consent and are responsible for all activities under your Account.
After your consent, you may provide Non-personal Bike Settings information like speed Limit, total distance, battery Level, boot screen, ringing sound, etc. when you sync Urtopia App to your bike.
After your consent, you may provide Non-personal Bike stats data, e.g. distance, speed, acceleration, battery level, motor power, slope, cadence and torque, so that Urtopia can use these data to improve your riding experience and to provide fascinating features on the App.
After your consent, you may provide Location data of the bike to Urtopia, which is necessary to enable Anti-theft and Find-my-bike functions.
After your consent, you can interact with Urtopia E-Bike by pressing the righthand button and speaking to it. We may capture voice commands during those interactions. We cannot prevent people from providing additional Personal Information when they interact with the Urtopia E-Bike, and such information may be recorded in the Voice Commands and documented in the transcriptions derived from Voice Commands. We do not routinely monitor the Voice Commands, but it is our policy to delete such Personal Information disclosed in the Voice Commands and transcriptions if we become aware of it.
1.3 Passively-Collected Data
Urtopia Products and Services are designed for adults, not children. As such, this Site is not intended for children under 16 years of age. No one under age 16 may provide any personal information to or on the Site. If you are under 16, do not use or provide any information on this Site or on or through any of its features/register on the Site, make any purchases through the Site, use any of the interactive or public comment features of this Site or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us.
Like most Web-based Services, we automatically receive and record information on our server logs from your browser when you use the Urtopia Site. We may use a variety of methods, including Beacons and Cookies, to collect this Passively-Collected Data. The information that we collect with these automated methods may include, for example, your IP Address, Cookie information, a unique device or user ID, browser type, system type, the content and pages that you access on the Urtopia Site, and the “referring URL” (that is, the page from which you navigated to the Urtopia Site). We may also collect information when you use the App, such as your device model and name, operating system & version, and mobile network information. We may also automatically collect certain logistical information in server logs, such as information about how you use various features of the Services, and length and frequency of each use.
- MailChimp (to sync subscription data for email Services);
- Google Cloud Speech API (online voice recognition and transcription technology);
- Fabric (to analyze customer usage patterns).
2. How We Use Information We Collect
Urtopia uses the information we collect to establish, maintain, and enhance our relationship with you and to improve our Products and Services.
We use your contact information to get verifiable consent for your use of the Urtopia Products and Services. When you sign-up for an Account, we use the Personal and Non-Personal Information you provide to create and maintain your Account.
We use the information we collect to display and personalize content on the Urtopia Site; to provide and maintain our Services; to enhance your user experience; to improve the performance or design of our Products; to send you notifications, confirmations, updates, product announcements, security alerts.
We use the information we collect for customer service. During customer service communications, we may collect information to respond to your communications and requests, provide customer service, request feedback, and otherwise contact you about your use of the Services. We may monitor and analyze demographic trends relating to customer service requests.
Information we share with others. We are committed to protecting information that identifies you personally, where you have chosen to keep it private. While we may share Non-Personal Information, we will only share your Personal Information in the following circumstances:
With Urtopia service providers. When Urtopia hires a service provider to help operate the Urtopia Site or our business (including vendors and payment processors), Urtopia may give access to certain Personal Information necessary for the service provider to undertake its work, in which case we will require those service providers to honor the privacy of your Personal Information. Urtopia currently uses the following third-party service providers to provide its Services. In doing so, it discloses only your email address (but no other Personal Information about your or your child) to these service providers:
- SumoMe Mailing List or Newsletter (operated by Sumo Group, Inc.): By registering for the Urtopia newsletter or joining Urtopia’s mailing list, your email address will be added to the SumoMe contact list. Your email address may also be added to the mailing list when you create a Urtopia Account, sign up for our Services, or make a purchase from us. Sumo Group, Inc. does not disclose your email address to any third parties.
- MailChimp (operated by The Rocket Science Group, LLC): Urtopia sends email messages using MailChimp’s email message-sending Services. The Rocket Science Group, LLC does not disclose your email address to any third parties.
- Fabric (owned by Google, Inc.): Fabric is a software development and integration kit that allows Urtopia to analyze its customers’ general usage patterns, including the rates of Urtopia users on daily and weekly bases. The Fabric kit does not collect Personal Information about you or your child, and no such Personal Information is transmitted to or shared with Fabric or Google.
With Urtopia affiliates and partners. We may share some or all of your Personal Information with our affiliates and partners (including a parent company, subsidiaries, other companies that we control or that are under common control with us, and joint venture partners), in which case we will require those affiliates and partners to honor your Personal Information.
In the event of merger or sale. If Urtopia is involved in a merger, acquisition, bankruptcy, or any form of sale of some or all of its business, Personal Information may be transferred with the business.
We aggregate and anonymize data. We may use information we collect in aggregated forms. That is, we may combine information about our users with that of others in an anonymous manner to create Aggregate Information. Aggregate Information does not contain or constitute Personal Information. In such cases, there will be no identifying information disclosed about you. When we employ non-Urtopia companies to anonymize or aggregate data on our behalf, we will protect your Personal Information by following our requirements for sharing Personal Information with third-party service providers.

4. Our Data Security and Storage Practices
We work hard to protect Urtopia and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. Urtopia follows industry standards and best practices to help protect your Personal Information from unauthorized access, use and disclosure. For example, we store the personal information we collect on computer systems with limited access and located in controlled facilities. When we transmit highly-confidential information (such as a credit card number or password) over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Urtopia stores and processes Personal Information in databases hosted in the United States. We make good faith efforts to store data securely, but do not guarantee the safety of data.
Please be aware that, despite our efforts, no security measures are impenetrable. Unfortunately, we cannot guarantee that any method of data transmission will protect against any interception or other type of misuse.
5. Your Choices Regarding the Use of Your Information
You may request access to and correction of the Personal Information we retain. If you request that we delete Personal Information, including but not limited to Voice Commands, they will be permanently deleted, and we will no longer retain that Personal Information in any form. If you wish to review or have us delete such Personal Information or Voice Commands, please email us at email@example.com.
If you wish to stop further collection or use of your Personal Information, including Voice Commands, or to delete your email address, you may choose to permanently delete your Account by emailing us at firstname.lastname@example.org. Please note that, by permanently deleting your Account, you will disable the most of the advanced functionality of the Urtopia E-Bike. To reinstate functionality at a later date, you may set up a new Account using a different email address.
You may also opt out of receiving emails from us at anytime by following the unsubscribe instructions in those emails.
6. International Users
Depending on applicable law, you have the right to submit a complaint or object to our collection and use of your information at any time, or to require us to review, transmit, change, or delete your information that we have collected and retained. We will fulfill your request to exercise any of these rights within the applicable time period subscribed by such laws. You can exercise these rights, express concerns, or obtain additional information about the use of your personal information by contacting us. We will only retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected and to the extent permitted or required by law.
6.1 California Privacy Rights
Urtopia adopted this section to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and applies solely to residents of the State of California (“California Consumers”). Without limiting the foregoing, this section provides California Consumers with the disclosures and notices required under the CCPA. Certain exceptions and limitations may apply to a California Consumer’s rights and Urtopia’s obligations under the CCPA.
No Sale of Personal Information. If Urtopia ever chooses to sell Personal Information, you would have the right to opt out of the sale of your Personal Information.
Right to Disclosure. California Consumers have the right to request that we disclose certain information about our collection and use of your Personal Information over the past 12 months.
Right to Access. You have the right to request that we provide you with access to specific pieces of Personal Information we have collected about you over the past 12 months (also called a “data portability request”).
Right to Deletion. You have the right to request that we delete any of your Personal Information that we collected from you and retained, with certain exceptions.
Submit a Consumer Privacy Request. To exercise any of the above rights, please submit a verifiable consumer privacy request to Urtopia by email at email@example.com.
Verification. We cannot respond to your request or provide you with Personal Information unless we can verify your identity and your authority to make the request and confirm that the Personal Information relates to you.
Authorized Agent. You may make a verifiable consumer request on behalf of your minor child. Otherwise, only you, or a person you have designated in writing as your authorized agent or who is registered with the California Secretary of State to act on your behalf, or to whom you have provided power of attorney pursuant to California Probate Code sections 4000 to 4465 (“Authorized Agent”) may make a verifiable consumer request related to your Personal Information.
Urtopia’s Response. We endeavor to respond to a verifiable consumer request within 45 days of receipt. If we require more time, we will notify you in writing of the reason and extension period. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding receipt of the verifiable consumer request. If we cannot comply with part or all of your request, we will explain the reasons in our response. We do not charge a fee to process or respond to your verifiable consumer privacy request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Other California Privacy Rights. California Civil Code sections 1798.83-1798.84 (the Shine the Light Act) entitles California residents to request disclosure regarding Personal Information sharing with affiliates and/or third parties for marketing purposes. 6.2 Your rights under GDPR or Data Protection Act 2018
If you are an EU/UK resident, you have the following rights:
- You may request access to the Personal Data we process about you;
- You may request us to correct, update, shield or delete your personal information in our records;
- You may request a copy of the Personal Data we have processed about you. We can - on your request - send this copy to another party, so you don't have to send the Personal Data yourself;
- You may file a complaint against processing your Personal Data;
- You may file a complaint if you are under the impression that we process your data unlawfully;
- You may always withdraw your consent to process your Personal Data. In that case, we will no longer process your Personal Data for the purpose for which consent is necessary.
